In Malaysia, solicitors’ remuneration for specified non-contentious conveyancing work is governed by the Solicitors’ Remuneration Order 2023 (SRO 2023). The SRO 2023 came into operation on 15 July 2023.

SPA Legal Fees Calculator Malaysia
A Sale and Purchase Agreement (SPA) records the terms agreed between the seller and purchaser for the sale and purchase of the property.
For a typical subsale property transaction, the purchaser’s solicitor may carry out work including reviewing the property and title particulars, preparing or reviewing the SPA, conducting relevant searches, advising on the transaction, attending to completion requirements and preparing or completing the relevant transfer documentation.
Under Table A of the First Schedule to the Solicitors’ Remuneration Order 2023, the scale fee for a sale and transfer is presently:

Accordingly, an SPA legal fees calculator applies the relevant scale to provide an estimated legal fee based on the transaction value.
The SRO also contains separate provisions for transactions governed by the Housing Development (Control and Licensing) Act 1966, so the applicable legal fee for a developer transaction may differ from an ordinary subsale transaction.

MOT Stamp Duty Calculator Malaysia
The Memorandum of Transfer, commonly referred to as the MOT, is the prescribed instrument used to transfer registered ownership of property where the relevant individual or strata title has been issued and the transfer is capable of registration.
For this reason, purchasers frequently search for an MOT calculator Malaysia or MOT stamp duty calculator when estimating the total cost of acquiring a property.
Stamp duty on a transfer of property is generally calculated based on the consideration or market value of the property, whichever is higher, subject to the applicable provisions of the Stamp Act 1949.
For transfers falling within Item 32(a) of the First Schedule, the progressive rates are:

This example assumes the ordinary rate under Item 32(a) and does not take into account any exemption, remission or different statutory treatment that may apply to the particular purchaser or transaction.

Stamp Duty, LHDN and Property Transfers in Malaysia
In Malaysia, stamp duty is administered by the Lembaga Hasil Dalam Negeri Malaysia (LHDN/HASIL) under the Stamp Act 1949. Stamp duty is generally imposed on instruments rather than the underlying transaction itself. For property transactions, this may include instruments transferring property and instruments relating to financing or security.

How Is Property Stamp Duty Calculated in Malaysia?
A property stamp duty calculator should not simply assume that the SPA purchase price will always be the final value used for stamp duty.
For a property transfer, the relevant basis can be the consideration stated in the transaction or the property’s market value, whichever is higher.
The Valuation and Property Services Department (Jabatan Penilaian dan Perkhidmatan Harta or JPPH) has a role in property valuation for stamp-duty purposes. Where valuation is required, the value determined through the adjudication process can therefore affect the final stamp duty payable.

Stamp Duty for Non-Citizen Property Purchasers
The citizenship or residency status of a purchaser may also affect the applicable stamp duty.
The current First Schedule to the Stamp Act 1949 contains a separate provision under Item 32(aa) for a sale of property to a foreign company or a person who is not a Malaysian citizen and not a permanent resident.
Accordingly, a non-citizen purchaser should not automatically rely on the ordinary progressive MOT calculation above.
If you are purchasing property as a foreign purchaser, the applicable stamp duty and any State Authority requirements should be checked specifically for the proposed transaction.
Loan Agreement Legal Fees Calculator Malaysia
Where a property purchase is financed by a bank or financial institution, the financing documentation is a separate legal transaction from the SPA.
The Third Schedule of the Solicitors’ Remuneration Order 2023 deals with charges, debentures and other security or financing documents.
For the principal financing instrument under Table A, the current scale includes:

Other Costs When Buying a Property in Malaysia

Is the property purchase price always used to calculate stamp duty?
Not necessarily. For a property transfer, stamp duty may be based on the consideration or the market value of the property, whichever is higher. The adjudication and valuation process may therefore affect the final amount payable.
